Swami Prasad sends legal notice to Noida CP, demands Rs 11.50cr in damages

Lucknow, Aug 13 (UNI) Samajwadi Party (SP) leader and MLC Swami Prasad Maurya has sent a legal notice to Noida Police Commissioner Alok Singh demanding him to tender an unconditional apology and pay damages to the tune of over 11.50 crore for dragging his name in the Shrikant Tyagi case.
Maurya has asked Singh to pay the damages within 15 days, failing which "appropriate criminal and civil actions will be initiated against him".
The SP leader's counsel, JS Kashyap, in the notice has stated that Maurya -- a popular political leader with good reputation in society, has been dragged into the Tyagi case with malicious intention.
Kashyap, a Supreme Court advocate, in the legal notice said: "My client has served six terms as Member of Legislative Assembly and he has held the post of Cabinet Minister in UP Cabinet as well as two terms served as leader of opposition in the assembly.
"You have leveled serious allegations against my client without any basis and evidence in the press conference held on August 9," he said.
It was on Tuesday that Singh had alleged that Tyagi secured a secretariat vehicle pass through Maurya.

The SP MLC has claimed that the statements have been made deliberately and maliciously intended to drag his name along with Shrikant Tyagi.
"That due to the aforesaid allegations against my client without any basis and purely on malice, my client have suffered mental agonies, and torture. Furthermore, my client is facing continuous mental torture and harassment," Kashyap has stated.
He said that the defamatory statements made by the CP in the press conference has "injured the reputation of my client and will tarnish the political career of my client".
"That your malicious acts have resulted in defamation of my client. They are also intended to be harmful to the feeling of each family member of my client. It has caused severe hardship and prejudice to my client and his family and has caused unwarranted misery and loss of reputation and status of my client in the public and society," he has stated.
Kashyap has claimed that the aforesaid allegations leveled against "his client by you knowing them to be false and with intention to defame my client are giving rise to civil liability for damages against you to compensate my client.
"My client reserves the right to initiate criminal action against you under the law," he has stated.
Serving the legal notice, Kashyap stated, "you must tender an unconditional public apology through Electronic Media as well as publish the same in the News Papers with regard to the baseless allegations leveled by you against my client..."
He has stated that his client is also demanding special damages on account of defamation, mental torture, agony, and injury inflicted to his and his family reputation, honor due to the statements, which
you have made in the press conference.
Swami has demanded Rs 10 crore as injury or loss to reputation as a person; Rs 50 lakh for mental torture and physical agony and loss in family honour and another Rs 50,000 on pretext of legal assistance and general charges.
"You are required to comply with the above demands and pay the above-said amount to my client within 15 days from the receipt of this notice, failing which my client shall be constrained to initiate appropriate criminal and civil actions against you as per law, entirely at your risk and cost. Take full notice accordingly," said the notice.
Shrikant Tyagi was arrested on August 9 by the Noida police, who also recovered an SUV bearing the secretariat pass issued to the MLAs.
Alok Singh during the press conference said that Swami Prasad Maurya provided the pass to Tyagi.
Singh had said that a vehicle bearing a pass meant for the MLAs has been recovered. "When quizzed, the accused (Tyagi) told the police that the pass was provided to him by his old political associate Swami Prasad Maurya. We are verifying it and further action will be taken on the basis of the evidence," the Noida CP said.
