After HC intervention, 108 Ambulance Union agrees to resume duty

Shimla, Aug 10 (UNI) The 108 GVK EMRI employees union on Friday agreed to withdraw the strike call given four days ago, pressing for demands before the management, as the Himachal Pradesh High Court took assurance from the Union leaders to join their duties by Friday evening.

A Division Bench of acting Chief Justice Sanjay Karol and Justice Sandeep Sharma directed both the parties to resolve the disputes by Friday afternoon, postponing the hearing till afternoon.

The court directed union leader Vijay Kumar, Vishnu, Vijay Kumar, Ram and Puran Chand, who were present in the court, to sit across the table at the Office of the Deputy Commissioner of Shimla, to sort out their issues with the management of GVK EMRI.
Before the meeting, both the parties gave assurance in the court to resolve their issues and that some of the employees shall report to their duties at their respective places by Friday evening.

After the post afternoon hearing at 1500 hrs in the court, Deputy Commissioner of Shimla Amit Kashyap placed on record, the Memorandum of Understanding.
The court observed during the hearing that the meeting convened by the DC has resulted into immediately calling off the strike, with an undertaking by all the drivers or technicians of reporting back for their duties forthwith and positively within the next 24 hours.

The counsel for the GVK EMRI gave assurance before the bench that DVD Prasad, State Head of Operations, would not take any disciplinary action taken against the striking employees and allow them to resume their duties and no further consequential action shall be taken on this count.
Mr Kumar, Mr Ram and Mr Chand assured the court that henceforth, neither their Union shall give any call for strike, nor shall any one of the members of their Union resort to the same. However, for venting out their genuine grievances, they shall resort to the mechanism provided in law.

The Court also directed the striking employees to furnish affidavit that they would resume their duties and submit affidavit before the respective DCs in the state, which would be further submitted before the court, through DC Shimla.
Mr Chand stated that similar undertakings should also be filed by Vikramjeet Singh Saini and Dinesh Kaushal. The court directed them also to remain present in the Court, along with the aforesaid persons, on the next date of hearing on August 21.
