Well settled process followed in Justice Muralidhar's transfer: Law minister

New Delhi, Feb 27 (UNI) Law minister Ravi Shankar Prasad on Thursday reacting to the transfer of Delhi High Court judge Justice S Muralidhar to the Punjab and Haryana High Court said that the transfer was done pursuant to the recommendation of the Supreme Court collegium headed by the Chief Justice of India.
"Transfer of Hon’ble Justice Muralidhar was done pursuant to the recommendation dated 12.02.2020 of the Supreme Court collegium headed by Chief Justice of India. While transferring the judge consent of the judge is taken. The well settled process have been followed," Mr Prasad tweeted.
Also accusing the Congress of politicising the transfer, Mr Prasad said, "The Party, which is the private property of one family, has no right to lecture about objectionable speeches. The family & it’s cronies have routinely used the harshest words against the Courts, the Army, the CAG, the PM and the people of India."
"By politicising a routine transfer, Congress has yet again displayed its scant regard for the judiciary. People of India have rejected Congress Party and hence it is hell bent on destroying the very institutions India cherishes by constantly attacking them," he tweeted.
Justice S Muralidhar, who was hearing the Delhi violence case, has been transferred to Punjab and Haryana High Court, a notification in this regard was issued late Wednesday night by the Department of Justice, Ministry of Law and Justice.
The notification read, "In exercise of the power conferred by clause (1) of Article 222 of the Constitution of India, the President, after consultation with the Chief Justice of India, is pleased to transfer Shri Justice S Muralidhar, Judge of the Delhi High Court, as a Judge of the Punjab and Haryana High Court and to direct him to assume charge of his office in the Punjab and Haryana High Court".
President Ram Nath Kovind approved the transfer of Justice Muralidhar on the advice of Chief Justice of India SA Bobde, exercising the powers conferred under Article 222 of the Constitution, it said.
The Supreme Court Collegium sent a recommendation to the government on February 12 for the transfer of three judges, including Justice Muralidhar.
On Wednesday, Justice Muralidhar had lashed out at the Central Government and the Delhi police for not registering an FIR against the leaders who had given inflammatory speeches during the violence in the capital.
