J&K HC stays judgement on hoisting of state flag on buildings, vehicles

Jammu, Jan 1 (UNI) Jammu and Kashmir High Court, Jammu wing today stayed the operation of the judgment on hoisting of state flag on official buildings and vehicles.
The judgment was given by the Division Bench of State High Court Comprising Justice Tashi Rabstan and Justice Bansi Lal Bhat after hearing Senior Advocate Sunil Sethi with Advocate Veenu Gupta in a LPA filed by Farooq Khan Retd IG and presently a National Secretary of Bhartiya Janta Party challenging the judgment of writ court regarding hosting of State flag and For changing the position of Governor to SadriRiyasat.
During the course of arguments Sr Advocate Sunil Sethi submitted that it is contended by the appellant that writ court has traveled beyond the scope of the petition and dealt with the questions which did not form the issues raised in the pleading and it is further submitted that Circular issued by the GAD did not have the statutory flavour and same cannot be enforced in absence of a positive mandate contained in the section 144 of the constitution of Jammu and Kashmir which merely describes the dimension of the state Flag.
