SC reiterates: insurers must compensate victims despite policy breach, can recover from vehicle owner

New Delhi, Nov 12 (UNI) The Supreme Court today reaffirmed that insurance companies cannot escape their liability to compensate victims of motor accidents merely on the ground of policy violations by the vehicle owner.
A Bench, comprising Justices Sanjay Karol and Manoj Misra, observed that even when there is a breach of insurance policy conditions, the insurer must first compensate the claimant and can later recover the amount from the owner of the vehicle.
“Where the contract of insurance is not disputed, even on breach of insurance conditions, this Court had allowed recovery of compensation from the insurer by giving right to the insurer to recover the same from the vehicle owner,” the Bench noted while allowing an appeal filed by a claimant.
