SC delivers blow to TMC: Refuses special order on vote counting staff; ECI rules to stand

New Delhi, May 2 (UNI) The Supreme Court on Saturday refused to pass any order on a plea of Trinamool Congress challenging the Election Commission's decision to deploy central government and central public sector employees during the counting of votes for the West Bengal assembly elections.
The Trinamool Congress had earlier challenged the Election Commission's decision in the Calcutta High Court, but the court dismissed its petition, stating that the Election Commission had jurisdiction to appoint counting personnel.
After hearing arguments from the lawyers representing the Trinamool Congress and the Election Commission, a bench of Justices P.S. Narasimha and Jaymalya Bagchi stated that no order was necessary in this matter.
The Election Commission's lawyer's statement that the Commission would fully comply with the April 13 circular was recorded.
"No further orders are necessary except to reiterate the statement of Mr. Naidu (for ECI) that the circular dated April 13th 2026 will be implemented in letter and spirit" the Court said in AITC plea against ECI direction that at least one among the Counting Supervisor and Counting Assistant at each table must be a Central Government/ Central PSU employee.
In the petition, the Trinamool Congress had objected to the use of central government employees and employees of central government public sector undertakings for vote counting. The Commission's April 13 circular said it is mandatory to appoint at least one Central Government employee or Central Public Sector Undertaking employee as an observer or assistant observer for counting of votes.
