Delhi Court issues notice to CM Atishi  and Sanjay Singh in Defamation Complaint case

New Delhi, Jan 16 (UNI) A Delhi Court on Thursday issued notice to Chief Minister Atishi Marlena and AAP MP Sanjay Singh in a defamation complaint case filed by Former Congress MP Sandeep Dikshit.
Additional Chief Judicial Magistrate (ACJM) Paras Dalal after hearing the case said, " Matter is at the stage of cognizance and in compliance of first proviso to section 223 BNSS, the proposed accused persons are to be given opportunity of being heard.
Accordingly, on filing of PF within 3 days from today, let notice be issued to both proposed accused persons returnable for 27.01.2025".
Sandeep Dikshit filed a fresh complaint u/s 223 BNSS for offence alleged u/s 356 r/w 3(5) BNS against the accused in the court.
The allegation in the complaint is that the two proposed accused have made defamatory allegation during their press conference on December 26, 2024. The allegations made by the accused persons are that they alleged the complainant to have colluded with opposition political party to receive crores of rupees and further have election campaign for Delhi Assembly Election 2023 funded by opposition political party.
Counsel for complainant submitted that Complainant belongs to Indian National Congress, the opposition party is Bharatiya Janata Party and the proposed accused persons represent the Aam Aadmi Party.
The complainant has alleged that vide the statements of the proposed accused persons, his image has been tarnished and defamed which was published and circulated in the media. Moreover, the complainant has alleged that proposed accused no.1 has reiterated the allegations through a post on ‘X’ a popular Internet social media channel.
The Counsel further submitted that the case invokes Section 356 read with Section 3(5) of the BNS Act, 2023, and includes additional charges under Section 223 and Section 222(1) for summoning and punishing the accused.
