Delhi HC issues notice to A Raja, Kanimozhi in 2G spectrum case

New Delhi, Mar 21(UNI) After hearing an appeal from Enforcement Directorate, the Delhi High Court
on Wednesday issued notice against former Telecom Minister A Raja, DMK legislator Kanimozhi and others
in the 2G spectrum case.
Central Bureau of Investigation has alleged that there was a loss of Rs 30,984 crore to the exchequer in allocation of licenses for 2G spectrum.
The Enforcement of Directorate filed a charge sheet before a special court and alleged that Rs 200 crore was paid by Swan Telecom (P) Ltd (STPL) promoters to DMK-run Kalaignar TV.
A special court was set up in March 14, 2011 for hearing 2G cases exclusively and has acquitted Essar Group promoters Ravi Kant Ruia and Anshuman Ruia and six others in a separate case arising out of the 2G scam probe.
CBI Special Judge O P Saini has heard the case against A Raja, Kanimozhi and 15 others under the provisions of Indian Penal Code and the Prevention of Corruption Act dealing with offences of criminal conspiracy, cheating, forgery, using as genuine fake documents, abusing official position, criminal misconduct by public servant and taking bribe.
Mr Saini last year in the month of December has passed an order of acquittal in favour of Raja, Kanimozhi and 15 others, including former Telecom Secretary Siddharth Behura, Raja’s erstwhile private secretary R K Chandolia, Swan Telecom promoters Shahid Usman Balwa and Vinod Goenka, Unitech Ltd MD Sanjay Chandra and three top executives of Reliance Anil Dhirubhai Ambani Group (RADAG) Gautam Doshi, Surendra Pipara and Hari Nair, in the CBI’s 2G case in 2G spectrum case by saying that the prosecution had “miserably failed” to prove the charges against the accused.
Delhi High Court Justice S P Garg on Wednesday issued notice to Raja, Kanimozhi and others after hearing appeal on behalf of CBI and ED as the prosecution has challenged the order of acquittal passed in 2G spectrum allocation scam case.
The court further directed them to file the reply of the appeal within two weeks and listed the matter for May 25.
