New Delhi, Feb 22 (UNI) The Supreme Court on Thursday said the three-judge bench judgement on land acquisition, which was overruled by another three-judge bench of the court, would now be heard by a larger bench of the top court.
The top court's Thursday ruling comes in the light of an unprecedented situation arising from a three-judge bench judgement being overruled by another three-judge bench of the court.Apparently, the Supreme Court wants to resolve the unprecedented situation.
A two-judge bench of the apex court, headed by Justice Arun Mishra referred to Chief Justice of India (CJI) Dipak Misra for posting land acquisition matters before a larger bench to decide whether a three-judge bench on February eight was correct in interpreting the land acquisition law of 2013.
On Wednesday, a three-judge bench of Justices Madan Lokur, Kurian Joseph and Deepak Gupta had hinted about breach of judicial discipline by a three-judge bench headed by Justice Arun Mishra, which on February 8 had overruled a 2014 judgment by another three-judge bench.
Justice Lokur-led bench had passed an interim order asking coordinate SC benches and the HCs not to entertain any plea on compensation relating to land acquisition, thus virtually stalling implementation of Justice Mishra-led bench's Feb 8 judgment.
