New Delhi, Jun 15 (UNI) The Supreme Court on Monday issued notices on the Centre's petitions seeking the transfer of multiple cases pending before various High Courts that challenge the constitutional validity of the Transgender Persons (Protection of Rights) Amendment Act, 2026.
A vacation bench comprising Chief Justice of India Surya Kant and Justice V Mohan directed that proceedings in all related matters pending before various High Courts shall remain stayed until further orders.
The bench also issued notices to the petitioners who have challenged the Transgender Persons (Protection of Rights) Amendment Act, 2026, before the High Courts and sought their responses to the Centre's transfer petitions.
The bench observed that it may either transfer all the petitions to the Supreme Court or club them together and assign the matter to a particular High Court for adjudication. The Centre has sought the transfer of petitions pending before the Rajasthan, Karnataka, Kerala and Delhi High Courts.
Appearing for the union government, Solicitor General Tushar Mehta urged the court that if the cases are transferred to the Supreme Court, they should be heard by a three-judge bench. He pointed out that the 2014 NALSA judgment, which forms the basis of the challenges to the Transgender Persons (Protection of Rights) Amendment Act, 2026, was delivered by a two-judge bench.
