New Delhi, May 13 (UNI) The Supreme Court on Monday dismissed the petition filed by a lawyer, Mohammad Nizamuddin Pasha, challenging the Election Commission of India's decision not to prepone voting commencement time from 7AM to 5AM keeping in view the heat wave and Ramzan festival.
"We dismiss the petition. There is no merit in the petition," the division bench of the apex court, headed by Justice Indira Banerjee, said in its order.
The lawyer-cum-petitioner, Pasha, had moved the top court seeking a direction to the Election Commission of India to advance the polling time from 7AM to 5AM during Ramzan.
While dismissing the petition, the court said, it can't dictate the polling hours. "It is ECI's discretion. Logistical problems will also occur," the court said.
