New Delhi, Dec 15 (UNI) The Centre, through the Ministry of Defence, on Saturday moved an application for correcting yesterday's Supreme Court judgment on the Rafale deal case which had absolved the Narendra Modi-led government.
'The error in these 2 sentences, appears to have occurred, perhaps, on account of a misinterpretation of a couple of sentences in a note handed over to the Apex Court in a sealed cover,' the application stated.
The Central government, in its application, said that its use of 'is' in the sealed cover submitted to the Apex Court had become 'was' in the judgment. The CAG 'is' to submit its report to PAC & then the redacted part is put in public domain.
It is to be noted that the Centre would mention their ‘correction’ application over Rafale case before the CJI Bench in the Apex Court on January 2, next year when the SC reopens after winter vacation.
The observations in the judgment have also resulted in a controversy in the public domain, and would warrant correction by this Court in the interest of justice, the UOI's application, stated.
The UOI, in its application, further said, in the interests of justice and in the facts and circumstances of the case, it is most respectfully prayed that the Apex Court may graciously be pleased to direct the corrections in paragraph 25 of yesterday's Rafale judgement.
The Supreme court, had in its judgement yesterday, dismissed all the writ petitions and also refused to give a go ahead for a Special Investigation Team (SIT) probe into the alleged irregularities and corruption in the Rafale deal as claimed by the petitioners in the case.
