New Delhi, Sep 16 (UNI) Homegrown company -- MagFast beverages -- has won a 15 year long battle with PepsiCo to use trademark "Mountain Dew" for their product.
Magfast owner, Syed Ghazuiddin, in a statement on Tuesday said that he had started a business in India in 2000 by manufacturing packaged drinking water under the name " Mountain Dew" while US giant PepsiCo started its business after 3 years in 2003.
He elaborated that both the product were different in nature. "One is citric soda where as our product is drinking water", Mr Ghazuiddin said.
In the statement, he accused PepsiCo Inc of bulldozing his company by filing a lawsuit for infringement of their alleged TradeMark "Mountain Dew', originally before the Delhi High Court on the ground that an Indian company named Magfast beverages was selling packaged drinking water in Delhi. However, after the Court realized that no such business was done by Magfast beverages in Delhi, the said suit was transferred to the Courts of Hyderabad.
So now after 15 years, the Hyderabad Court dismissed the suit filed by PepsiCo and specifically rejected the its claim on the alleged trans border reputation and claim of infringement.
