NGT gives nod to Rs 45 Cr Territory cancer care centre at IGMC

Shimla, Mar 15 (UNI) National Green Tribunal gave nod to Rs 45 Cr territory cancer care to come up at Indra Gandhi Medical College (IGMC) as the state government filed an application before the tribunal in the matter.
Four member Principal bench comprised of Chairperson of NGT, Mr Adarsh Kumar Goel, Judaical Member SP Wangdi and K Ramakrishnan and Expert Member Dr Nagin Nanda decided the matter on Mar 8,2019 disposing of the application filed by the state of Himahcal.
This project was sanctioned by the Union Government in 2016 to built a Territory cancer care centre along with existing cancer hospital was on the verge of lapse as the executing agency Himachal Pradesh Public works department was about to compete this project by month of March this year.
It is worthwhile to mention here that all constructions in the Core and green areas of Shimla was banned by the NGT on the petition of Yogendra Mohan Sengupta versus Unions and Others.
Clipping the powers of MC Shimla and Town and Country Planning Department to permit and approve the construction in the town, NGT had constituted an implementation committee and a supervisory committee to allow such constructions in Shimla planned area while giving judgement in the .Yogendra Mohan Sengupta versus Unions and Others, case in month of Nov 16, 2017.
Passing order on Mar 8, 2019 on the state government application filed in pursuance of its judgement, NGT maintained that Supervisory Committee constituted by the tribunal has dealt with the subject matter of the to expand Cancer Hospital Block at Shimla.
The order also said that Committee vide minutes of meeting on Feb 13, 2019 found that the expansion of the cancer hospital within existing premises is necessary.
NGT directed the state that regarding potential for damage to the environment, the committee recommended expansion subject to the condition that the provisions of Solar Energy , Rain water Harvesting, Bio-Medical Waste Management and Evacuation Plan for disaster management should be in place along with the Environment Impact Assesment (EIA) report.
In view Supervisory Committee observation NGT said that it is open to the Medical College to proceed in terms of the recommendations of the committee subject to the said condition laid down .
Filling the miscellaneous application before the NGT in month of December last year state
government pleaded the principal bench to allow the project since the funds allotted by the
center was on the verge of lapse if it could not completed before march this year.
Moreover State Government also moved in the SC recently against NGT judgement in the Yogendra Mohan Sengupta versus Unions and Others, case also pleaded before the apex court that tribunal withhold similar projects of the state government beside the public constructions the judgement should be set aside.
