New Delhi, Jan 18 (UNI) The Supreme Court will hear, on next Monday, a petition, filed by one of the Nirbhaya convicts on death row, Pawan Kumar Gupta, that he was a juvenile at the time of the offence and the Delhi High Court had not taken his fact into account while confirming the sentence.
Convicted in the December 16, 2012, horrific gang rape case, Pawan Gupta, 23, had yesterday moved Apex Court, challenging the HC order by which his plea to be tried as a juvenile offender was rejected.
His lawyer submitted that the High Court did not consider his prayer while rejecting his age factor.
A bench, headed by Justice R Banumathi and consisting of two other judges, will hear the plea.
Pawan is facing the gallows along with Akshay Kumar Singh,( 27) Vinay Sharma (24) and Mukesh Singh (27), who were sentenced to death for gang raping and murdering the 21-year-old medical student in South Delhi.
