New Delhi, Jul 20 (UNI) Supreme Court on Monday expressed serious concern over how the gangster, Vikas Dubey, facing as many as 64 cases, was granted parole by courts.
A bench headed by Chief Justice SA Bobde said "I think it is an institutional failure and we want to go into this issue."
The apex court sought details of orders releasing Dubey on parole.
The Supreme Court was hearing a batch of petitions seeking court monitored CBI/NIA probe into the encounters of Dubey and his associates.
Dubey was killed in an encounter by Uttar Pradesh Police on July 10.
Earlier, UP Police had informed the Supreme Court that Vikas Dubey had never surrendered, but was nabbed after a tip-off from the Madhya Pradesh Police.
One of the petitioners told the court that the judicial inquiry ordered by UP Government in the matter was illegal as it was not in accordance with Section 3 of the Commission of Inquiry Act, 1952.
Supreme Court said, it is appalled that gangster Vikas Dubey with so many cases was out on parole and killed 8 policemen, saying it shows failure of the system.
Vikas Dubey, who was facing 65 FIRs, was on parole.
Appearing for UP DGP, Harish Salve said, even policemen have fundamental rights.
"In this matter can police be accused of excessive force when they are engaged in a live encounter with a dreaded criminal? Hard core criminal Dubey slaughtered cops in his village," Mr Salve said.
The Apex Court will now hear the matter on July 22 (Wednesday).
