Sushant Singh case: Probe without FIR against provisions of CRPC, Bihar govt tells SC

New Delhi, Aug 13 (UNI) Bihar government on Friday submitted the Supreme Court that the plea of Sushant Singh's live-in partner Rhea Chakraborty seeking transfer of the case from Patna to Mumbai is ineffective and should be dismissed as they have registered First Information Report (FIR) in the case and transferred the investigation to the Central Bureau of Investigation (CBI).
The Bihar government, in its written submissions filed through advocate Keshav Mohan, said, that the Mumbai police has adopted a lackadaisical approach in the case and registration of an FIR was mandated by a police officer in terms of the CrPC section 154.
However, the Mumbai Police failed to register the FIR due to political pressure and didn't cooperate with the Bihar Police in the probe, according to the written submission.
On the other hand, Ms Chakraborty, told the Apex Court that transfer of probe to the CBI at the behest of Bihar Police was without the state’s jurisdiction in the case.
She also argued that transfer plea was maintainable, pointing out the FIR which clarifies that no part of the offence has taken place in Bihar. "Even the FIR alleges that all acts have happened only in Mumbai and Patna has only been mentioned owing to the complainant’s residence,” she said.
Hindi cinema actor Sushant Singh Rajput, a native of Bihar, was found dead in his apartment in Mumbai on June 14. His father K K Singh alleged that Rs 15 crore were transferred from son's bank account within a short span of time and registered an FIR against Ms Chakraborty and others of abetment of suicide, criminal conspiracy and cheating.
Later he asked Bihar Chief Minister Nitish to transfer the case to the CBI as according to him Mumbai police was showing lackadaisical approach in investigating the case.
