New Delhi, Aug 28 (UNI) The Delhi High Court on Friday dismissed fugitive businessman Mehul Choksi's petition seeking a pre-screening of Netflix's 'Bad Boy Billionaires,' a docu-series that delves into the transgressions of some of the country's biggest defaulters, including Choksi's nephew Nirav Modi.
Through Advocate Vijay Aggarwal, the maternal uncle of fugitive Indian businessman Nirav Modi approached the High Court to direct the over-the-top (OTT) platform Netflix to show him the preview of the documentary, before it's release on September 2.
The High Court said Choksi can file a civil suit as what is being alleged as an infringement by him is a private right and can be exercised in a civil suit.
The court also refused to grant him a pre-screening asserting that there are no regulations to control the content being streamed on OTT platforms.
According to Choksi's petition, he fears his name may have been used in connection with Nirav Modi in the series and he claimed his relation to the fugitive diamantaire is only that of an uncle and nephew.
Choksi also claimed that he has been 'falsely' accused of various crimes in India.
On Wednesday, Senior advocate Neeraj Kishan Kaul, appearing on behalf of Netflix, had said that Choksi has been mentioned lightly in the two-minute part of Nirav Modi.
Fugitive Diamantaire Choksi and others are being probed by the Enforcement Directorate on money laundering charges, in connection with an over USD 2 billion alleged bank fraud at a Punjab National Bank (PNB) branch in Mumbai.
The Diamond merchant, along with Nirav Modi and and his wife Ami Modi, have fled from India.
However, Nirav was arrested in London in March, 2019 and is currently lodged in a UK jail.
As per the trailer of 'Bad Boy Billionaires: India,' the investigative docu-series explores the greed, fraud and corruption that built up and ultimately brought down the country's most infamous tycoons, including Vijay Mallya, Nirav Modi, Subrata Roy and Byrraju Ramalinga Raju.
