HP CM terms ITAT as Kangaroo court

Shimla, Dec 18 (UNI) Himachal Pradesh Chief Minister Virbhadra Singh today lashed out at the Income Tax Applete Tribunal (ITAT) for dismissing his appeal to reopen his Income Tax Assessment, terming the tribunal a Kangaroo court, alleging that the outcome was to unleash political vendetta against him, on the behest of Union Finance Minister Arun Jaitely and BCCI President Anurag Thakur. Replying to media queries about his case rejected recently by the Income Tax Appellate tribunal, Mr Singh said it was based on political vendetta and to hear his case by ITAT, two special judges were sent by Mr Jaitley from Delhi. The Octogenarian Chief Minister charged that Mr Jaitley and Mr Thakur are behind him and trying to target him to unleash political vendetta, as the outcome of the case revealed. The Chief Minister stated that he would appeal against the ITAT in the High Court and the Supreme Court, as per their requirements. On December 8, Chandigarh-based ITAT dismissed Mr Singh's Appeal filed against the Income Tax department's move to reopen assessment of tax returns submitted by him for financial years 2009-10, 2010-11 and 2011-12. The ITAT bench headed by judicial member I C Sudhir and accountant member R S Syal on December 8 this year, dismissed Mr Singh's appeal. The order, issued by Chandigarh bench, observed 'We fail to comprehend as to how the assessment order accepting the genuineness of carrying out the agricultural operations and earning a huge income in such circumstances can be considered as an order made after proper inquiry as has been canvassed by the assesses. 'It is a case of a patent non-application of mind by the AO (assessing officer) to the facts, which were loudly calling for in-depth investigation. In our considered opinion, the Additional Commissioner of I-T was fully justified in setting aside the assessment order and directing the AO to frame a fresh assessment." the ITAT said in the order, dismissing Mr Singh's appeal. CBI has registered a case of Disproportionate Assets last year against Mr Singh and his family members. Moreover, ED also lodged an FIR on the charges of Money laundering in the matter.
