HC to consider framing of issues in Singhvi’s RS election petition

Shimla, Aug 12 (UNI) The Himachal Pradesh High Court will on August 14 take up the framing of issues in the election petition filed by senior advocate and Rajya Sabha MP Abhishek Manu Singhvi, challenging the outcome of the March 2023 Rajya Sabha polls in the state.
The matter will be heard by a single bench of Justice Bipin Chandra Negi. The hearing follows a request from the counsel for BJP Rajya Sabha member Harsh Mahajan, seeking time to respond to Singhvi’s submissions.
On April 2, 2025, the court had framed four issues, including the legality of the lot procedure, whether Singhvi had consented to it, and the maintainability of the petition. Singhvi’s counsel, Prashanto Sen, argued that the applicability of the correct statutory provision is a pure question of law that can be decided as a preliminary issue under Order 14 Rule 2 of the CPC. He maintained that there can be no estoppel against a statute and that alleged consent to an illegal procedure is irrelevant.
