Kochi, Sep 20 (UNI) Kerala High Court on Thursday while directing a College principal to readmit a girl student who had been expelled from the college hostel for using mobile phone, observed that, 'the right of access to internet is a fundamental right and a tool to ensure right to education'.
Justice PV Asha observed that 'the restriction on the right of the students cannot be permitted to stand in the eye of the law'.
The court said "when the Human Rights council of United Nations has found that the right to access to the internet is a fundamental freedom and a tool to ensure right to education, a rule or instruction which impairs the said right of the students cannot be permitted to stand in the eye of law."
BA English third semester student, Faheema Shirin RK, of Sree Narayana Guru College, Kozhikode, has challenged the hostel regulation that students should not use mobile phones during study hours in night time. She was expelled from the college hostel for using the mobile phone.
The court directed the college principal to readmit the student and protect the rights of the students under Article 21 of the constitution.
