Former SC bench arbitrarily quashes HPCA case FIR : Virbhadra Singh

Shimla, Nov 21 (UNI) Six time chief minister Virbhadra Singh hailed the SC revisit its recent decision allowing quashing of FIR lodged against Himachal Pradesh Cricket Associations.
Interacting with media persons on the recent Development on Tuesday Mr Singh said that after accepting the
mistake the bench has set a good precedent which is a welcome step.
" I think it would restore the faith of people in the Indian Justice Delivery system " he said adding that the earlier to this matter was listed before the another bench which did not heard the party.
Mr Singh said that Monday decisions of SC to rehear this mater shows that court judicial decided
to accept the mistake as it would not be possible to use single broom to sweep different cases .
It it worthwhile to mention here that SC on Monday decided to hear the matter again on the prayer of Mr. Singh counsel that he did not allowed to argued in the matter as bench had quashed an FIR against BJP MP Anurag Thakur and others in HPCA case related to alleged encroachment of land for the construction of Dharamsala cricket stadium by “mistake”.
In a divisions Bench of Justices AK Sikri and SA Nazeer, Virbhadra Singh's counsel stated on Monday that he had arraigned as a respondent in the case filed by HPCA however he did not allowed to argue the case before bench quashed all the FIRs.
It is worthwhile to mentioned here that on November 2 top court quashed FIRs against Thakur, his father and former CM Prem Kumar Dhumal and others in two separate cases — one related to alleged irregularities in granting land on lease for the construction of the stadium and another pertaining to alleged encroachment of government land.
SC decided to rehear the matter despite Senior advocate PS Patwalia, appearing for Thakur and
others, contended that there was no need to recall the order as the main FIR was already quashed
by the court.
The counsel representing Mr. Singh said the alleged order should be recalled as the apex court had by mistake quashed a separate FIR against Thakur and others in connection with a case related to alleged encroachment of land, where staff quarters of the education department of the state was situated.
He said no argument was advanced by them in the second FIR, which was quashed by the court “by mistake”.
However, Patwalia told the Bench that nothing survived in the FIR as the court had already appreciated the
facts in its November 2 verdict.
The FIR filed against the Mr Thakur, his father PK Dhumal and others by the Virbhadra Singh government
in 2012-13 allegedly violating lease rule after transferring land for the HPCA and dismentalling the servant
quarters of education departments for the Dharmshala Cricket Stadium . Mr Thakur moved to SC after
Himachal Pradesh High court dismissed the petitions of Mr Thakur to quahsed these FIRs.
