ED files charge sheet against 3 in environment pollution case in Jaipur

New Delhi, Jul 2 (UNI) Enforcement Directorate (ED) on Thursday said that it has filed ‘Prosecution Complaint’ under Prevention of Money Laundering Act (PMLA) against three before Jaipur PMLA Court in a money laundering case relating to Water (Prevention and Control of Pollution) Act, 1974 and the Environment (Protection) Act,1986.

The three accused were Agribiotech Industries Ltd of Sikar and its Managing Directors namely Girdhar Gopal Bajoria and Ashutosh Bajoria.

The central financial probe agency took up the investigation under PMLA on the basis of two criminal complaints filed by the Rajasthan State Pollution Control Board, Jaipur before the Srimadhopur Court of the Judicial Magistrate against Agribiotech Industries Ltd and it Managing Directors for the contravention of section 43 and 44 of the Water (Prevention and Control of Pollution) Act and section 24,25 and 26 of the Environment (Protection) Act.

During ED’s investigation, it revealed that Agribiotech Industries Ltd was having permission for production of ‘Extra Natural Alcohol’ (ENA) and Rectified Spirit (RS) of 45000 Liters per day, whereas the company was producing more than 65000 Liters per day, an excess of illegal excess production of 1,38,08,304 liters during the period from December 2007 to July 2012.

The company generated illegitimate profit of Rs 8.3 crore during this period.

The probe also revealed that company was also not maintaining Effluent Treatment Plant (ETP) mechanism as envisaged under the State Pollution Board’s guidelines, thereby resulting an illegitimate gain of Rs 8,20,285.

Accordingly, proceeds of crime amounting to Rs 8.38 Crore, in the form of immovable property situated at SP-156, RIICO Industrial Area at Ajitgarh in Sikar was attached which has been confirmed by the Adjudicating Authority (PMLA) in New Delhi.

The Prosecution Complaint has been filed on the basis of outcome of investigation and confiscation of attached property valuing Rs 8.38 Crore has also been prayed apart from prayer for punishing the accused under PMLA, the ED said.
