Dhankhar questions Mamata Govt over shielding of Gyanwant Singh from an enquiry

Kolkata, Nov 26 (UNI) West Bengal Governor Jagdeep Dhankhar on Thursday questioned the Mamata Banerjee Government how it could shield Gyanwant Singh from an enquiry even after judicial finding of his act as "unconstitutional and invasive of right to life without authority of law".
Taking to his twitter handle, Mr Dhankhar said, "High Court Single Bench judgment dtd 14.8.08 returned finding that Gyanwant Singh, IPS, the then Police Dy Commissioner(HQ)
@MamataOfficial 'invaded right to life without authority of law' while discharging duty as public servants & judicially declared his act 'unconstitutional'.”
" Supreme Court in its judgment dated March 01,2011 held: 'Any action against the officers of the State Police Department, as suggested by the learned single Judge, shall be in accordance with law and service conditions applicable to them and after affording opportunity to them', " added the Governor.
"How can @MamataOfficial shield Gyanwant Singh @WBPolice from an enquiry even after judicial finding of his act unconstitutional & invasive of right to life without authority of law and pronounced him ‘guilty of exceeding police powers & thereby acted ultra vires Constitution’ ?" Mr Dhankhar asked.
Mr Dhankhar on Wednesday rued that "in flagrant breach of public duty Kolkata and State Police are in political overdrive" to take on political rivals of regime, saying, "Such actions of the Mamata Banerjee Government distanced from constitution & law."
Reacting to State Home Department tweet, Mr Dhankhar said, "Tweet @HomeBengal
is indicative of lawlessness in governance. What a shame-Governor as per it is ‘some quarters’."
"For over year CM & CS have not responded to issue of enquiry against Gyanwant IPS, " he stated.
"Urgent response of CS ⁦@MamataOfficial ⁩ sought over this. There is silence of CS & DGP on role #SSAPurkayastha #RinaMitra!" Mr Dhankhar said.
"Unfortunate that in flagrant breach of public duty police @KolkataPolice @WBPolice
are in political overdrive to take on political rivals of regime," the Governor added.
"Such actions @MamataOfficial distanced from constitution & law," he quipped.
Earlier, the West Bengal Government reiterated its commitment to transparency and probity in governance, while Mr Dhankhar came down heavily on the Mamata Banerjee Government for its alleged confrontational stance.
Taking to its twitter handle, the State Home Department said, "Repeated Attempts are being made from certain quarters to question conduct of public officers, their roles and responsibilities through tweets."
"Govt of West Bengal is committed to transparency and probity in governance," it added.
"We wish to put on record that there is no 'enquiry' pending against Sri Gyanwant Singh, IPS," it stated.
Mr Dhankhar took a swipe at the Mamata Banerjee Government for its alleged confrontational stance.
Taking to his twitter handle, Mr Dhankhar said, "Confrontation stance @MamataOfficial
-governance disaster- Farmers in State already lost direct benefit of Rs. 8,400 crores."
"Each farmer denied direct benefit of Rs 12,000," he added.
"Concerned @KolkataPolice @WBPolice similar strategy execution to preempt action against delinquents," Mr Dhankhar rued.
"Would not ‘fiddle’ in office with Governance @MamataOfficial getting unconstitutional & rule of law norms are in flames," he averred.
Expressing concern at the alleged silence of CS and DGP, Mr Dhankhar said, " Concerned at silence of CS and DGP @WBPolice on enquiry against Gyanwant IPS; role #SSAPurkayastha #RinaMitra ! "
"Why CS and DGP suffering extra legal bossism!" he questioned.
"Mystery unfolding on report of Sept 01 filed of Sept 09 and its media surfacing on Sept 26. The epicentre actor, presently not in seat, in full operation, unmindful that law spares none," he iterated.
"Such ganging to provide cover to law violators is severe crime," the Governor said and hoped sanity will prevail.
