Deport Pak woman, her minor child, J&K HC to government

Srinagar, Dec 31 (UNI) The Jammu and Kashmir High Court has again directed the government to deport a Pakistani woman and her minor child, languishing in a state jail for the past four years. The court had also passed similar order in May this year directing the government to deport the woman to Pakistan within three weeks. A single bench of the HC comprising Justice Muzaffar Hussain Attar ordered deportation of Rubina and her minor child by or before first week of February following confirmation by Pakistan High Commission that she was a Pak national. The Pak High Commission has provided a detailed report to the Government of India (GoI) about her paternal relations which confirmed her Pak nationality, which has been lodged in district jail, Amphala in Jammu. She was arrested on November 6, 2012 and booked in an FIR under section 14 of Foreigners’ Act by police at Kanachak Jammu. However, she was later detained under Public Safety Act (PSA) alongwith her minor child at Kotbalwal Jail, Jammu. Justice Attar after hearing argument from defence counsel advocate Mir Shafqat Hussain who moved the Habeas Corpus Petition ordered deportation of Rubeena and her minor child by or before first week of February. The court said that in view of the confirmation by Pak Embassy about the nationality of the Rubeena the government must make arrangements for her deportation along her minor child to Pakistan. A bench of Justice Ali Muhammad Magrey had passed a similar judgement in the case in May this year directing the state government deport her. However, she was not deported . However, the government informed the court that Rubeena was provided consular access with the officials of Pakistan High Commission on 26-2-2013 at central jail Amritsar.
