New Delhi,Apr 15 (UNI) The Delhi High Court on Thursday rejected the bail plea of northeast Delhi-riots accused Sharukh Pathan Khan, who had allegedly fired shots at a police head constable, noting that his picture brandishing “speaks volume of his participation in the riots”.
Khan had come out in open on February 24, 2020, during violence near Jaffarabad Metro Station and opened fire in which police constable Deepak Dahiya was injured.
His picture of brandishing the pistol was clicked by a journalist and had made rounds in social as well as print and electronic media.
“The video and pictures played before this court has shaken the conscience of this court how petitioner could take law and order in his hands,” Justice Suresh Kait said as quoted by LiveLaw.
The single-judge bench also said it was hard to believe, as submitted by the petitioner, that he had no knowledge that the alleged act can harm some one present on the spot.
In his petition, Khan stated that he was not an absconder as claimed by the police as no notice was issued for his appearance by the authorities.
The petitioner submitted he was made the poster boy of the riots by the media before any judgement.
Khan also objected to sec 307 (attempt to murder) of the IPC levelled against him as he claimed that had shot on the side not towards the victim and had no intentions to kill him.
Karkardooma Court in November last year had too refused to grant bail to Khan.
Khan was arrested on March 3, 2020, by the Delhi police from Shamli in Uttar Pradesh.
Communal clashes had broken out in northeast Delhi on February 24,2020 after violence between citizenship law supporters and protesters spiralled out of control leaving at least 53 people dead and around 200 injured.
