Delhi Court sentences Ex-Coal Ministry Secretary HC Gupta, others in coal scam case

New Delhi, May 22 (UNI) A local court today ordered two-year imprisonment term to Former Coal Secretary H C Gupta and two Senior Government Officials K S Kropha and K C Samaria for irregularities in the allocation of a coal block. In October 2012, CBI had registered an FIR in the matter and on March 27, 2014 had filed a closure report in the case. CBI Special Court has rejected the closure report on October 13, 2014 and summoned Gupta and others as accused for appearance before the court and on October 14, 2016 has framed charges against the accused persons. The Special CBI Court after hearing the matter held the accused person guilty for multiple offences by saying Gupta, Kropha and Samria had entered into a "criminal conspiracy" with KSSPL and Ahluwalia to commit "criminal misconduct" for procuring coal block allotment in favour of Madhya Pradesh based Kamal Sponge Steel and Power Ltd (KSSPL). This has been noted that Gupta made "dishonest misrepresentation" before the then Prime Minister, who had retained the Coal Ministry portfolio. Special CBI Judge Bharat Parashar after hearing arguments on behalf of the Prosecution and Defence has convicted Former Coal Secretary H C Gupta and two serving Senior Government Officials K S Kropha and K C Samaria for irregularities in the allocation of the Thesgora-B Rudrapuri coal block in Madhya Pradesh to a private firm on May 19, 2017 and has acquitted Chartered Accountant Amit Goyal from the case. There are about 10 more coal cases are pending against Gupta and the proceedings are going on individually as per order of the Supreme Court who has last year dismissed the plea seeking a joint trial in all these cases. Special CBI Judge Bharat Parashar today after hearing arguments on behalf of the Prosecution and Defence Counsel passed an order to two year jail term to Gupta, Kropha and Samaria, along with a fine of Rs one lakh each on the three convicts in coal scam case. The court further imposed a fine of Rs one crore on convicted Madhya Pradesh based firm Kamal Sponge Steel and Power Ltd, which was the beneficiary of the allocation of Thesgora-B/Rudrapuri coal block in the state and its Managing Director Pawan Kumar Ahluwalia was sentenced with three-year jail and a fine of Rs 30 lakh for misrepresenting facts in its application before the Ministry of Coal (MOC), which was then headed by Prime Minister Manmohan Singh. The court has granted bail on a personal bond of Rs one lakh and one surety of like amount soon after the sentence was announced to enable the accused to move the High Court, challenging the trial court sentence.
