New Delhi, Mar 28 (UNI) Big setback for the victim's families, with the Supreme Court had rejected a bunch of review petitions against the acquittal of three men in the 2012 Chhawla gangrape & murder case.
The three-judge bench of the Supreme Court, headed by the Chief Justice of India (CII) Dr Dhananjaya Yeshwant Chadrachud, noted, In the judgement that the subsequent event of one of these men killing someone else after the acquittal won't be a ground to reconsider the November verdict, the 9-page order copy of the Supreme Court which dismissed the review petitions, revealed.
The Apex Court bench, also comprising Justices S Ravindra Bhatt and Bela M Trivedi, dismissed the review petition filed by the Delhi Police and Centre, Victim girl’s father, social activist Yogita Bhayana, Urrakhand Bachao Manch and Uttarakhand Lok Manch.
"After having considered the judgment and other documents on record, we do not find any error either factual or legal, apparent on the face of record requiring review of the aforestated judgment passed by this Court," the Supreme Court said, in its judgement on March 02.
The Review petitions have been filed by the State of Delhi seeking review of the common judgment and order of November 07, 2022, passed by this Court in a criminal appeal.
The Review petitions had been filed, before the Supreme Court, by the Centre, victim's parents and social activist, Yogita Bhayana and others, against the order of the Supreme Court against the acquittal of the three men accused in the 2012 Chhawla Gang Rape and murder case.
The Review petitions had sought a re-look at the Chawla gang rape case acquitting three accused persons in the brutal gangrape and murder case.
A three-judge bench of the Supreme Court, headed by former Chief Justice of India (CJI) Uday Umesh Lalit (Now Retired) and also comprising Justices S Ravindra Bhat and Bela M Trivedi, had in its verdict on November 07, acquitted three men -- Rahul, Ravi and Vinod -- who were accused of abducting the girl (victim) while she was returning home from her work place on February 09, 2012.
"Many glaring lapses have been noticed during the course of the trial, the Supreme Court said. "Out of the 49 witnesses examined by the prosecution, 10 material witnesses were not cross-examined and many other important witnesses were not adequately cross-examined by the defence counsel", the Apex Court had said, earlier in its order.
The three accused were sentenced to death by the lower court in 2014, which was affirmed by the Delhi High Court in the same year.
The three accused -- Rahul, Ravi and Vinod -- were accused of abducting the girl while she was returning home from her work place on February 09, 2012. The police later found a mutilated body of the girl near Rewari in Haryana on February 14, 2012, with multiple wounds. In the autopsy it was found out that she was attacked, raped and acid was poured on her eyes.
