71-year old man gets 10 years in jail culpable homicide case

Thane, Dec 31 (UNI) A 71-year-old man from Thane city’s Patlipada area of GB road who was found guilty of an offense falling under culpable homicide not not amounting to murder was convicted on Tuesday and sentenced to ten years of rigorous imprisonment by the district court here.
In his order, the District Judge found the accused Rajesh Mahalam Soni, guilty under section 304 of the IPC for the death of his own son Ravishankar Soni, 38 and fined him a sum of Rs 5,000.
Appearing for the prosecution, Additional Public Prosecutor Rekha Hiwrale told the court that the father and son duo jointly owned a chawl which had rooms in the Palti Pada locality.
While the father transferred some rooms to his daughter the deceased son transferred some rooms on his wife's name.
This resulted in the quarrel between the duo frequently and it was on September 30, 2016 the accused attacked his son with a knife injuring him badly. The injured was rushed to the hospital where he died while being treated, the court was told.
In his order the judge noted, “culpable homicide is not murder if the offender whilst deprived the power of self-control by grave and sudden provocation, causes the death of persons who gave the provocation or cause the death any other person mistake or accident. Whether the offense is culpable homicide or murder depends upon the degree of risk to human life. If the death is likely result it is culpable homicide if it is most probably result it is murder.
In the present matter, it is admitted fact that the accused is the real father of the deceased. They both were addicted to liquor also and there was the probability to cause death or such injury is likely to cause death.
The judge noted that the prosecution has proved the charges against the accused who need to be convicted and sentenced.
